Terms of Service

1. Agreement to these terms

By accessing or using Mithril Builder ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Mithril Builder is operated by Mithril Labs ("Mithril", "we", "us").

2. The Service

Mithril Builder is an AI-powered development environment for building Web3 market data applications. It lets you describe an app in natural language (e.g., a dashboard, a leaderboard, an explorer, an analytics tool), watches an AI agent generate the code, and runs the app in an isolated sandbox preview. You can publish your generated apps to your own subdomain.

The Service integrates with the Mithril market data API, which provides read-only access to public market data from multiple perp DEXs and prediction markets. Mithril does not execute trades, does not hold user funds, and does not provide investment advice.

3. Your account

To use the Service, you need a Mithril account. You are responsible for:

• Keeping your account credentials secure.
• All activity that happens under your account.
• Notifying us immediately of any unauthorized access.
• Providing accurate account information.

You must be at least 18 years old to use the Service.

4. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy. You must not:

• Use the Service to develop or deploy code that violates any law.
• Attempt to gain unauthorized access to any part of the Service.
• Reverse-engineer, decompile, or disassemble the Service.
• Circumvent rate limits, authentication, or billing mechanisms.
• Use the Service to generate, store, or distribute malware, phishing content, or illegal content.
• Attempt to manipulate financial markets using apps built through the Service.
• Use the Service to build apps that target minors or facilitate gambling or gaming in jurisdictions where these are regulated.

5. Intellectual property

Your content: you retain full ownership of the code, prompts, and other content you create using the Service. You grant Mithril a limited license to store, process, and display your content solely to provide the Service.

Our platform: the Mithril Builder platform, the AI agent prompts, the knowledge docs, templates, and branding are owned by Mithril Labs. You do not receive any license to the platform itself beyond the right to use the Service as described.

Generated code: the code generated by the AI agent for your project is yours to use, modify, distribute, and commercialize. You are responsible for ensuring that any third-party libraries pulled in by the generated code are used in compliance with their respective licenses.

Templates: starter templates provided by Mithril are licensed to you under the MIT License. You are free to use them commercially.

6. Subscription plans and credits

The Service offers free and paid plans. Paid plans include a monthly credit allowance for AI generation. Credits reset each billing cycle, with up to 20% rollover of unused credits. You may also purchase one-time credit packs that expire 6 months after purchase.

Subscriptions renew automatically until canceled. You can cancel at any time from your account page; cancellation takes effect at the end of the current billing period, and you keep access until then. Refunds are not issued for partial months unless required by law.

Prices are in USD (or EUR equivalent) and exclude applicable taxes. We may change prices with 30 days notice.

7. Market data disclaimer

IMPORTANT: Mithril Builder is a development tool for building market data applications. It is not a financial adviser, broker, or custodian, and any application you build with the Service is your sole responsibility.

• Crypto markets involve substantial risk. Data displayed by apps built on Mithril is informational only.
• Past performance does not guarantee future results.
• Mithril does not warrant that generated code is free of bugs, accurate, or suitable for any purpose.
• Mithril is not a broker, custodian, or financial institution. We do not execute trades, hold your funds, or provide investment advice.
• You are solely responsible for complying with the regulations that apply to your jurisdiction, including tax obligations.

8. Third-party services

Apps you build may connect to third-party exchanges, prediction markets, or data providers. These third parties are governed by their own terms and conditions, which you are responsible for reading and following. Mithril is not responsible for any downtime, errors, or losses caused by third-party services.

9. Warranty disclaimer

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. To the fullest extent permitted by law, Mithril disclaims all such warranties.

10. Limitation of liability

To the fullest extent permitted by law, Mithril's total liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the amounts you paid Mithril in the 12 months preceding the claim, or (b) 100 EUR.

Mithril is not liable for any indirect, incidental, consequential, or punitive damages, including lost profits, missed opportunities, or data loss.

11. Indemnification

You agree to indemnify and hold Mithril harmless against any claim, damages, or legal costs arising from (a) your use of the Service, (b) your violation of these Terms, (c) your content, or (d) apps you build or deploy through the Service.

12. Termination

You may terminate your account at any time from your account page. We may suspend or terminate your account if you violate these Terms or the Acceptable Use Policy, or if required by law.

Upon termination, your access to the Service ends. We may retain certain data as described in our Privacy Policy.

13. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time. We will give reasonable notice of material changes to paid plan features when possible.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or via a prominent banner in the builder. Your continued use of the Service after changes means you accept the new Terms.

15. Governing law and disputes

These Terms are governed by the laws of France. Any dispute will be subject to the exclusive jurisdiction of the courts of Paris, France, unless a mandatory consumer protection law in your country of residence gives you a different right.
